Terms of Service

Acceptance of these terms

By accessing or using gmsomeday.com, app.gmsomeday.com, or any related GMSomeday application surface (the "Service"), you agree to be bound by these Terms of Service ("Terms") with Lemon AI LLC, 1309 Coffeen Avenue STE 1200, Sheridan, Wyoming 82801, United States. If you do not agree, do not use the Service. If you are accepting these Terms on behalf of an organization, you represent that you have the authority to bind that organization.

The service

GMSomeday is a personal chess-coaching web application. You may submit a Chess.com or Lichess username; the Service will fetch that username's public game archive, analyze the games for recurring patterns, and present the results as a personalized report.

During early access the Service is offered free of charge. We may introduce paid features in the future; if we do, we will update these Terms and give active users reasonable advance notice.

Billing and subscriptions

No paid plan is live as of the effective date above. If paid features are introduced, the checkout flow will disclose the price, billing interval, renewal terms, included features, and cancellation method before you are charged.

Unless the checkout page says otherwise, paid subscriptions renew automatically until canceled. You authorize Lemon AI LLC and its payment processor to charge the payment method you provide for recurring subscription fees, applicable taxes, and other charges you agree to at checkout.

You may cancel a subscription through the account or billing controls we provide, or by emailing gregory@gmsomeday.com. Cancellation stops future renewal charges; it does not automatically refund charges already incurred unless required by law or expressly stated at checkout. We may change prices or paid features with reasonable advance notice to active paid users.

Accounts and usernames

You may use the report feature without creating an account, by submitting a public Chess.com or Lichess username. Accounts use Google sign-in or magic links; we do not use passwords. If you choose to create an account to save reports and track follow-through across sessions, you agree to:

  • Provide accurate account information and keep it up to date.
  • Maintain the security of your sign-in method and browser session.
  • Accept responsibility for all activity that occurs under your account.

You may delete your account data from your account settings, or by emailing gregory@gmsomeday.com. Some limited records may be retained as described in the Privacy Policy.

Acceptable use

You agree not to:

  • Use a submitted username, report, share card, duel, or other output to harass, stalk, shame, impersonate, dox, or harm another person.
  • Submit private, non-public, or unlawfully obtained chess data.
  • Attempt to access the Service by means other than the interface we provide, or attempt to probe, scan, or test the vulnerability of our systems.
  • Reverse-engineer, decompile, or otherwise attempt to extract source code from the Service, except to the extent this restriction is prohibited by applicable law.
  • Use the Service to build a competing product, or to train a machine-learning model on the Service's outputs.
  • Submit content that is unlawful, infringing, or intentionally misleading.
  • Circumvent rate limits, abuse public-platform APIs through the Service, or interfere with Chess.com, Lichess, or GMSomeday infrastructure.

Intellectual property

The Service, including its design, code, trademarks, and the report outputs we generate, is owned by Lemon AI LLC and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial chess-improvement purposes.

You may share screenshots of reports you generated publicly (e.g., on social media) provided you do not claim authorship of the underlying analysis and do not use them to violate these Terms.

Your content

The games you analyze are public data hosted by Chess.com or Lichess; they are not "your content" in the copyright sense. By submitting a username, you instruct us to fetch and analyze public data associated with that username. You represent that your submission and use of any resulting output is lawful and consistent with these Terms. If the report is tied to your account, you may delete it or the account data from settings or by emailing us.

Third-party platforms (Chess.com, Lichess)

The Service depends on the public APIs of Chess.com and Lichess. Your use of those platforms is governed by their own terms and privacy policies, not by these Terms. We are not responsible for changes those third parties make to their APIs, their availability, or their terms.

No professional advice

The Service provides educational chess-analysis content for informational and recreational purposes only. It does not constitute professional advice (legal, financial, medical, or otherwise). Do not use the Service as a substitute for advice from a qualified human chess coach for high-stakes competitive decisions.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Chess analysis is intrinsically probabilistic. We do not warrant that any specific claim in a report ("this move wins", "this is your biggest leak") is correct, only that report claims are generated from the engine-analysis, clustering, and verification systems used by the Service at the time the report is produced.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LEMON AI LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA, RATING, OR BUSINESS OPPORTUNITY) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT LEMON AI LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF EUR 100 OR THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms limits liability that cannot be excluded under applicable law (for example, liability for death or personal injury caused by negligence, or for fraud).

Indemnification

You agree to defend and indemnify Lemon AI LLC against any claims, damages, obligations, losses, and expenses (including reasonable legal fees) arising from (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any third-party right (including Chess.com's or Lichess's terms).

Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users or the Service. You may stop using the Service at any time and delete your account data from settings, subject to the retention limits in the Privacy Policy.

Sections that by their nature should survive termination (Intellectual Property, Billing, Disclaimers, Limitation of Liability, Indemnification, Arbitration, and Governing Law) survive.

Changes to these terms

We may update these Terms from time to time. Material changes will be communicated by updating the "Last updated" date at the top of this page and, where appropriate, by email or an in-app banner. Continued use of the Service after a material change constitutes acceptance of the updated Terms.

Arbitration and class-action waiver

Before filing a formal claim, you and Lemon AI LLC agree to try to resolve the dispute informally by emailing gregory@gmsomeday.com and giving the other side 30 days to respond.

For users in the United States, any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration under the Federal Arbitration Act, except for claims that may be brought in small-claims court and claims seeking injunctive or equitable relief for intellectual property misuse, unauthorized access, or abuse of the Service.

Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, unless the parties agree to another arbitration provider. Hearings may be conducted by video, phone, written submissions, or in Wyoming, as the arbitrator determines is appropriate.

You and Lemon AI LLC may bring claims only in an individual capacity. Class actions, class arbitrations, consolidated actions, private-attorney-general actions, and other representative proceedings are not permitted. You and Lemon AI LLC waive any right to a jury trial for disputes covered by this arbitration agreement.

You may opt out of this arbitration agreement within 30 days after you first accept these Terms by emailing gregory@gmsomeday.com with the subject line "Arbitration Opt Out" and the email address associated with your account, if any. Opting out does not affect any other part of these Terms.

If you are a consumer in the EU, EEA, UK, or another jurisdiction where mandatory law prohibits this arbitration agreement or class-action waiver, those provisions apply only to the maximum extent permitted by that law.

Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws rules, except that the arbitration agreement above is governed by the Federal Arbitration Act.

For consumers in the EU/EEA/UK: nothing in these Terms removes your mandatory consumer-protection rights under the law of your country of residence, and disputes may be brought before the competent court of your country of residence.

For US users: any dispute that is not resolved informally will be resolved exclusively in the state or federal courts located in Wyoming, unless applicable consumer law gives you a mandatory right to bring the dispute elsewhere.

Miscellaneous

  • If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
  • Our failure to enforce any right or provision is not a waiver of that right.
  • These Terms, together with the Privacy Policy, constitute the entire agreement between you and Lemon AI LLC regarding the Service.
  • You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
